Plain-language summary (not a substitute for the terms below): MorphPost is an AI tool provided “as is.” You are responsible for what you create and publish with it. Our liability is limited to the maximum extent the law allows, and most disputes are resolved by binding arbitration on an individual basis. Some jurisdictions give you rights that these terms cannot remove — where that is the case, those rights still apply to you.
These Terms of Service (“Terms”) are a binding agreement between you (“you,” “user”) and MorphPost, operated by Nexlite Agency (“MorphPost,” “we,” “us”). By creating an account, accessing, or using the MorphPost website, web application, or mobile applications (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & Account
- You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract.
- You are responsible for all activity under your account and for keeping your credentials secure.
- You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that violate these Terms.
2. The Service & AI-Generated Content
- MorphPost uses third-party AI models to generate, transform, and repurpose text based on your input. Output is produced by automated systems and may be inaccurate, incomplete, biased, or unsuitable for your purpose.
- You are solely responsible for reviewing, editing, fact-checking, and deciding whether to use or publish any output.
- The “humanization” feature is a stylistic tool. We make no guarantee that output will pass, evade, or achieve any particular score on any AI-detection system, plagiarism checker, or platform filter, now or in the future.
- You are responsible for ensuring your use of output complies with the rules of any platform you publish to, and with all applicable laws (including intellectual-property, advertising, and disclosure laws).
3. Acceptable Use
You agree not to use the Service to create, distribute, or facilitate:
- Unlawful, infringing, defamatory, harassing, hateful, or fraudulent content;
- Spam, malware, or content that violates the rights of others;
- Content that impersonates others or misrepresents authorship in a deceptive or unlawful way;
- Any attempt to reverse-engineer, overload, scrape, or circumvent security or usage limits of the Service.
We may remove content or suspend access for violations, at our discretion.
4. Your Content & Ownership
- You retain ownership of the text you submit (“Input”). Subject to your compliance with these Terms, you own the output you generate (“Output”), to the extent such Output is eligible for ownership under applicable law.
- You grant us a limited license to process your Input and Output solely to operate, secure, and improve the Service.
- AI Output may not be unique; similar output may be generated for other users. We make no warranty that Output is original or non-infringing, and you are responsible for clearing rights before use.
5. Tokens, Plans & Payments
- Usage is measured in tokens (1 generation = 20 tokens). Plans, prices, and token allowances are described at checkout and may change with notice.
- Payments are handled by third-party processors (e.g. Gumroad, and, in mobile apps, the applicable app-store billing). Their terms also apply.
- Except where required by law, fees are non-refundable. Token allowances may expire at the end of each billing cycle and do not roll over unless stated.
- We are not liable for errors, outages, or miscalculations originating from third-party payment providers, though we will make reasonable efforts to help resolve billing issues.
6. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. You use the Service at your own risk.
6A. Third-Party Services & Service Interruptions
The Service depends on third-party providers we do not control, including but not limited to our AI provider (the Anthropic Claude API), hosting and server infrastructure, payment processors, and email/SMS providers. We are not responsible or liable for any interruption, delay, degradation, downtime, data loss, or failure of the Service that is caused by, or arises from, any third-party provider, including outages, rate limits, suspensions, price or policy changes, maintenance, or discontinuation of their services. Any such interruption does not constitute a breach of these Terms by us, and does not entitle you to any refund except as required by applicable law or expressly provided by us. We will use commercially reasonable efforts to restore the Service but make no guarantee of availability.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- MorphPost, Nexlite Agency, and their owners, officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to the Service or Output, even if advised of the possibility.
- This includes, without limitation, damages arising from: inaccurate or harmful Output; your publication or use of Output; service interruptions, bugs, or errors; security incidents or unauthorized access; miscalculation of tokens, charges, or limits; and third-party services.
- Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the three (3) months before the event giving rise to the claim, or (b) USD $50.
8. Indemnification
You agree to indemnify and hold harmless MorphPost and Nexlite Agency from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or any law or third-party right.
9. Binding Arbitration & Class-Action Waiver
To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court where eligible. You and MorphPost waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be conducted on an individual basis.
Where mandatory local law prohibits pre-dispute arbitration agreements or class-action waivers, those specific provisions will not apply to you to the extent prohibited, and the remainder of this section will still apply.
10. Governing Law & Venue
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws principles. Subject to Section 9, the courts located in Pakistan will have jurisdiction, except where applicable mandatory law entitles you to bring proceedings in your country of residence.
11. Limitation Period
To the extent permitted by law, any claim relating to the Service must be filed within one (1) year after it arises, or it is permanently barred.
12. Changes, Suspension & Termination
- We may modify these Terms or the Service at any time. Material changes will be posted here with an updated date; continued use means acceptance.
- We may suspend or terminate the Service, or your access, at any time, with or without cause. Some features may be changed or discontinued without liability to you.
13. Severability & Waiver
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of it.
14. Mandatory Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applicable law says cannot be excluded or limited. Where such laws apply, the relevant clauses above are read down to the extent necessary to comply, and no further.
